Inter Law – Rehabilitation money wasted in accident claims

Victims who become seriously injured following an accident can benefit from rehabilitation as soon as possible.

Ed Fletcher, partner at Fletchers Solicitors, said that early intervention makes a crucial difference.

? One insurer reported recently that a review of around 50 randomly selected claims showed average cost savings of £120,000 for spinal injuries, £110,000 for back injuries and £95,000 for lower limb injuries where rehabilitation was applied,? he added, ?Other insurers might take a less dramatically positive view, but the general proposition that rehabilitation works is now uncontroversial.?

Mr Fletcher cites evidence where cases referred within three months took half the time to be settled than those which were not. He explains that there is a limited amount of time in which rehabilitation would be effective and this differs among individuals.

However, Mr Fletcher believes that the majority of money spent on rehabilitation by insurers is wasted because it is not tailored to suit the individual but is standardised.

? The more switched-on insurers and rehabilitation providers do now seem to be moving towards a more sophisticated and less wasteful approach to rehabilitation,? he said, ?As they compile, and hopefully share, more statistics on how different rehabilitation and case management approaches translate into settlement figures and timescales, we should all be in a better position to ensure everyone gets value for money from rehabilitation.?

When making an accident claim victims can receive ‘special damages’ which cover out of pocket expenses and reimbursement for physical care such as physiotherapy.

The claimant may also be able to receive rehabilitation treatment through their own insurance company as long as they did not cause the accident to occur.

‘General damages’ are those relating to the physical damaged sustained as a result of the accident and can also be claimed for.

In order to make a claim the victim must show injury sustained as a result of someone else’s negligent driving. A solicitor would help gather information relating to the accident ? such as tyre marks on the road ? and arrange for the claimant to have a medical examination to establish the severity of the injury.

Following the gathering of evidence and the medical examination the opponent’s solicitor is contacted to see if they accept liability. They will look through the information and make a decision. If liability is not accepted the case can be taken to court although this rarely happens and most cases reach agreement through a settlement.
