Severe back injury

£55,000 – £93,000

The most severe back injuries which do not involve paralysis but where there may be serious consequences which are not normally found in back injuries such as impotence or double incontinence.

Up to £45,000

This would be things like impaired bladder and bowl functions, severe sexual difficulties and unsightly scarring which may possibly need surgery in the near future.

£21,500 – £38,000

This would be in cases of disk lesions or fractures to the disks or to the vertebral. Despite treatment the claimant would be under constant pain and discomfort. Other things that fall under this bracket would be impaired sexual function, depression, personality change, unemployment and the risk of developing arthritis.

Moderate back injury

£15,250 – £21,500

This compensation bracket would fall under residual disability which is of less severity than the ones listed above. This bracket would contain a wider range of injuries e.g. crush fracture of the lumber vertebrae where there is a substantial risk of osteoarthritis and constant pain with the impairment of sexual functions. With continuous pain and discomfort a spinal fusion would be necessary, this could later cause an acceleration of back degeneration. Having the more serious combination of injuries would reward you with the upper end of the compensation bracket shown above.

£6,750 – £15,250

This bracket would be for frequently encountered injuries to the back such as disturbance of ligaments and muscles giving constant back ache and pain, as well as soft tissue injuries resulting in exacerbation of an existing back condition or resulting in constant relapses. The precise figure of compensation would depend upon the severity of the original injury and / or there is permanent or chronic disability.

Minor Back injury

£4,250 – £7,500

This would be covered under strains, sprains, disk prolapses and soft tissue injuries, this would be if the claimant has levels of recovery which is full or at a level which would not require surgery. The compensation would be awarded if the injury had healed within five years of the injury taking place.

Up to £4,250

This would be if the injury had healed within two years (the injury must be present for at least one month for you to receive compensation).
