Inter Law – Lorry driver sues firm

Lorry driver sues firm – 08/04/2017

A disabled lorry driver is suing his employers following an accident occurring in windy weather.

The Durham driver is making a personal injury claim with the help of his solicitors, Irwin Mitchell, because he believes the accident was avoidable.
Brian Young, 52, from Cragside, Chester-le-Street was driving on the busy A68 road when his lorry overturned during gusty weather.
His solicitors state that the vehicle’s load was insufficiently weighted because it consisted of empty milk bottles made of plastic. This increased the risk of the vehicle overturning in the winds.

Mr Young, said: “To be honest, it’s about time something like this is brought to light. Travelling up and down as much as we do, we’re seeing more and more Artics lying on their sides.” After leaving the carriageway Mr Young’s vehicle hit a wall and left him trapped for two hours.

A spokeswoman for Mr Young’s employer, TDG plc, said: “We take health and safety issues very seriously, but unfortunately we cannot comment on an ongoing investigation.”
