What to do after a Work Accident

Many suffer personal injury from accidents which occur within the workplace, but not many know the steps which they need to take in order to make a compensation claim against the employer. The following steps should be taken to ensure that you have a strong case against your employer to make a claim for compensation.

  • Report the accident to a senior member of staff
  • Make sure that the incident is recorded into the work accident book which every employer must keep by law. If a member of staff has volunteered to log the incident into the book make sure it is by double checking.
  • Take witness statements from employees and whoever else is present at the scene. Many employees may not come forward to speak against their employer which is why it’s always better to get names of whom was present and take statements at a later stage if required.
  • Take photos of the accident scene and make sure that photos are taken from all angles so the person viewing gets a good idea of the scene.
  • Visit your local doctor or a hospital to get your injuries checked out. Is it a good idea to always get yourself checked even if you are not in pain, make frequent visits to the doctor every time you suffer from the injury.
  • Keep all your receipts, from medical bills to travel expenses. This is something which will be compensated when winning the claim.

The above would provide sufficient evidence when making a personal injury claim for a work accident. If you are unclear or want more information about the steps you need to take for a claim call our advisors now on 0800 180 4022, our advice and service is totally free.

How will the Accident at Work Claim be funded?

We use the no win no fee * policy for our personal injury claims. We will not charge you a penny if you win or lose guaranteeing you keep 100% of the compensation awarded.

All our fees are paid by the third party’s insurance company who also pays your compensation. This is why it is compulsory for the employer to have insurance, covering them for such claims. The no win no fee * claim requires three elements to be completed before the claim is processed through, these are:

Liability – The evidence to prove that the employer was negligent and as a direct result of this the incident occurred.

Quantum – This element must show the injuries sustained from the negligence and the severity of them.

Limitation – the accident must have happened within three years of making a claim. We advice that you do not wait until the last months of the time period before making a claim as the third party may stretch the case beyond the time period.

Only once all the elements have been fulfilled can the claim be processed. All of this is covered in the steps above, if there are any extra steps the advisor will inform you.

All no win no fee * cases have three elements which must be met in order to process the personal injury claim for compensation
